Customs and Regulatory Compliance Policy

1. Purpose

The Customs and Regulatory Compliance Policy of Atlantis Logistics is designed to ensure that all shipments comply with Indian and international customs regulations and trade laws. This policy outlines the responsibilities of Atlantis Logistics, as well as our clients, in adhering to these regulations to ensure smooth and legal import/export processes.

2. Compliance with Indian Customs Regulations

Atlantis Logistics is committed to following all applicable Indian customs regulations, including those set by:

  • Customs Act, 1962
  • Directorate General of Foreign Trade (DGFT)
  • Central Board of Indirect Taxes and Customs (CBIC)
  • Export Import Policy of India
  • Customs Tariff Act, 1975

3. Client Responsibilities

Clients shipping goods through Atlantis Logistics are responsible for ensuring full compliance with customs and regulatory requirements. This includes:

a. Accurate Declaration of Goods

Clients must provide accurate descriptions of goods, including classification, value, quantity, and purpose. Misdeclaration may result in customs delays, fines, or penalties.

b. Necessary Documentation

  • Clients are required to submit all necessary customs documentation, including:
    • Invoice
    • Packing list
    • Bill of lading/airway bill
    • Import/export licenses or permits
    • Certificates of origin
    • Any other documents required by Indian or foreign customs authorities

c. Importer Exporter Code (IEC)

  • Indian businesses engaging in import/export activities must have a valid Importer Exporter Code (IEC) issued by the DGFT.

d. Customs Duties and Taxes

  • Clients are responsible for paying all applicable customs duties, taxes, and fees associated with their shipments. Atlantis Logistics may assist in calculating these costs, but final responsibility for payment lies with the client.

4. Prohibited and Restricted Goods

Certain goods are prohibited or restricted under Indian law and international regulations. Clients must ensure that their shipments comply with all applicable laws regarding prohibited and restricted items.

a. Prohibited Goods

Goods that are prohibited from import/export under Indian law include:

  • Narcotics and illegal drugs
  • Firearms and explosives (without proper licenses)
  • Hazardous and toxic materials
  • Endangered species and products derived from them (under the Wildlife Protection Act, 1972)
  • Counterfeit and pirated goods
  • Certain food items, plants, and seeds

b. Restricted Goods

  • Certain goods require special licenses or permits for import/export:
  • Pharmaceuticals
  • Precious metals and stones
  • Antiques and cultural artifacts
  • Chemicals and industrial products (as regulated by DGFT)
  • Dual-use goods (goods that can be used for both civilian and military purposes)

5. Compliance with International Trade Regulations

For international shipments, Atlantis Logistics ensures that all goods comply with applicable global trade regulations, including:

  • World Trade Organization (WTO) agreements
  • United Nations sanctions and trade restrictions
  • Foreign trade regulations of the country of origin and destination

Atlantis Logistics will not facilitate the shipment of goods that violate international trade sanctions or embargos.

6. Customs Clearance Process

  • We review shipping documentation for accuracy and completeness before submission to customs authorities.

  • Atlantis Logistics may engage with licensed customs brokers to expedite the customs clearance process on behalf of clients. Customs brokers will handle import/export formalities and ensure compliance with applicable laws.

c. Handling of Customs Duties

  • Atlantis Logistics can assist clients in calculating and processing the payment of customs duties, taxes, and fees. However, the final responsibility for payment lies with the client.

7. Delays Due to Customs Inspections

While Atlantis Logistics aims to minimize delays, customs authorities may inspect shipments for various reasons, including compliance checks, valuation reviews, or verification of documentation. These inspections may result in delays depending on individual countries and their unique customs laws for which Atlantis Logistics is not liable.

a. Inspection Fees

  • Any fees or charges incurred as a result of customs inspections are the responsibility of the client.

b. Mitigation of Delays

  • Atlantis Logistics will work with customs authorities to resolve any issues and expedite the release of goods when possible. Clients will be kept informed of the status of their shipments during customs inspections.

8. Limited Liability for U.S. and Canadian Customs and Border Patrol (CBP) Reviews

When shipping goods to the United States or Canada, all shipments are subject to review by the U.S. Customs and Border Protection (CBP) or Canada Border Services Agency (CBSA). Atlantis Logistics is not liable for any delays, inspections, or penalties resulting from customs reviews conducted by these agencies.

a. CBP/CBSA Inspections

  • Both the CBP and CBSA may conduct inspections of incoming shipments for a variety of reasons, including security concerns, compliance checks, and random inspections. These inspections may result in delays, and Atlantis Logistics is not responsible for any extended shipping times or costs associated with the inspection process.

b. Fines and Penalties

  • If any fines, penalties, or additional fees are levied by U.S. or Canadian customs authorities due to misdeclaration, incorrect documentation, or non-compliance with import/export regulations, the responsibility for these fines lies solely with the client. Atlantis Logistics will assist with providing documentation and coordinating responses but is not liable for the financial consequences of any customs violations.

c. Assistance with Documentation

  • Atlantis Logistics will work to ensure all necessary documentation is in order before shipment and will provide guidance to clients on compliance with U.S. and Canadian customs laws. However, final responsibility for the accuracy and completeness of customs documentation lies with the client.

d. Customs Clearance Delays

  • Any delays caused by CBP or CBSA are outside of Atlantis Logistics’ control. Clients will be notified promptly if shipments are under review or inspection, and Atlantis Logistics will provide updates on the progress of customs clearance. However, Atlantis Logistics is not liable for any financial losses, missed deadlines, or contractual penalties arising from customs delays.

9. Violations and Penalties

Failure to comply with customs regulations can result in:

  • Seizure of Goods: Customs authorities may seize goods that are misdeclared, under-invoiced, or otherwise non-compliant with Indian or international trade laws.
  • Fines and Penalties: Clients may be subject to fines, penalties, or criminal prosecution for customs violations.
  • Blacklisting: Repeat violators may be blacklisted by Indian, U.S., Canadian, or other international customs authorities, which could result in long-term restrictions on import/export activities.

Atlantis Logistics will not be liable for any penalties or legal action arising from customs violations due to incorrect information or documentation provided by the client.

10. Assistance with Compliance

Atlantis Logistics offers assistance to clients in navigating customs regulations by:

  • Providing up-to-date information on Indian, U.S., and Canadian customs and trade laws.
  • Assisting with documentation preparation and review.
  • Offering guidance on the classification and valuation of goods to avoid misdeclaration.
  • Working with customs brokers and legal experts when required.

11. Governing Law and Jurisdiction

This policy is governed by and construed in accordance with the laws of India. Any disputes arising from customs or regulatory compliance issues will be subject to the exclusive jurisdiction of the courts of the jurisdiction.

12. Amendments

Atlantis Logistics reserves the right to amend this Customs and Regulatory Compliance Policy in response to changes in Indian customs laws or international trade regulations. Clients are responsible for staying informed about the latest compliance requirements.
